General Terms and Conditions EVGA B.V
1) Definitions
- EVGA refers to EVGA B.V., located at Oude Liermolenweg 5, (2678 MN) De Lier, The Netherlands. Phone: +49 (0) 8918-904911. E-mail: supportEU@evga.com. Registration number with the Chambers of Commerce: 64112438, VAT number: NL855527249B01. EVGA is the user of these general terms and conditions.
- You refers to the consumer buying products from EVGA.
- General terms and conditions refers to these general terms and conditions.
- Registered carrier refers to the transportation company used by EVGA to deliver your order to you.
2) Applicability
These general terms and conditions apply to all offers made by EVGA and to all agreements regarding the sale of goods entered into by EVGA and by you.
3) Offers
EVGA aims to provide you with complete and correct information regarding our products and prices. The products sold by EVGA are required by law to be in conformity with what you may reasonably expect based on what would be needed for normal use of the product. Notwithstanding this, in the event a product is listed at an incorrect price or with incorrect information due to typographical error or error in pricing or product information, EVGA shall have the right to refuse or cancel any orders placed for products listed at the incorrect price. EVGA shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If you have already paid for the product, EVGA will immediately reimburse you.
4) Delivery
EVGA delivers orders placed online within all Member States of the European Union. EVGA will deliver the order to the address indicated by you. EVGA does not accept the following addresses as place of delivery:
- Hotels or Motels
- Mail or Package forwarding companies
- APO (Army Post Office) Addresses
- UPS Stores or Stores with shipping mailboxes
- PO Boxes
- Addresses that are non-standard or cannot be confirmed as a house or work place
Deliveries are only processed and delivered Monday through Friday except for holidays observed by EVGA. Orders placed on Saturday or Sunday will not be transported until the next business day once it is verified and approved for transport.
EVGA will deliver your order no later than 30 calendar days after you placed your order.
5) Risk Transfer
EVGA bears the risk of perishing of the good until it is delivered to you, or a third party other than the carrier and indicated by you acquires the product. Once the product has been delivered, the risk of damaging or perishing of the good is borne by you.
6) Payment
EVGA accepts payment using PayPal. Once you have placed your order, you will be guided through the payment process on our website.
7) Warranty and Replacement
EVGA B.V. offers differing warranty terms from the date of purchase. To see which terms apply to the warranty you chose see our warranty terms on our website http://eu.evga.com/support/warranty/. If you require information on how to return your order under your warranty, please contact customer service at supporteu@evga.com.
8) Right of Withdrawal
You have the right to withdraw from this contract within 14 days without giving any reason.
The withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the registered carrier and indicated by you acquires, physical possession of the goods. If your order is delivered in separate pieces or as separate goods, the withdrawal period starts from the day on which you acquire, or a third party other than the registered carrier and indicated by you acquires, physical possession of the last good or piece.
To exercise the right of withdrawal, you must inform EVGA of your decision to withdraw from this contract by an unequivocal statement. You may use the attached model withdrawal form, but it is not obligatory. This form can be sent to supporteu@evga.com.
In order to process your right to withdraw and to return your order, you need to register the return on our website eu.evga.com where you obtain a Return Merchandise Authorization number, and can choose the option ‘refund’.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
9) Effects of Withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
10) Your obligations in case of withdrawal
You are obliged to send back the goods, without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired.
You will have to bear the direct cost of returning the goods.
You are obliged to return the goods undamaged, in an “as-new” condition and as far as possible in the original packaging. You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
Combos and bundles including two or more items that must be purchased together to receive a discount will require that all items are returned for a refund.
11) Complaints
In case you have any complaints regarding our products or the handling of your order, you are required to submit your complaint fully and clearly described within a reasonable period to supporteu@evga.com. EVGA will confirm receipt of your complaint and will indicate the time estimated to consider your complaint. In any event, EVGA aims to consider your complaint within a maximum of 14 calendar days from receipt of your complaint.
12) Applicable Law
Dutch law applies to these general terms and conditions and to all offers done by EVGA and all orders placed with EVGA.
